<body-html>
1. This competition is open to all persons aged 18 and over except Win Property Online Limited employees or members of their immediate family, agents or any other person who is connected with the creation or administration of this competition.

2. By entering this competition the entrant will be deemed to have read and understood these rules and to be bound by them. The competition is governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. In the event of playing this competition online, by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions. The Promoter will not be held responsible for any entrant entering any of our competitions unlawfully. If in any doubt you should immediately leave the website and check with the relevant authorities in your country.

3. (a) To enter the competition, follow the on-screen instructions. Select the number of tickets you wish to purchase. You will then be shown a football match photograph displayed on the computer screen (from which the original ball has been permanently erased). Using all the information shown in the use your skill and judgement to correctly identify the location which you consider the judge will decide is the most likely position of the centre of the ball. Click on the screen to mark this spot (you can see your spot’s coordinates on the screen). The computer will register this spot as your entry into the competition. In case of multiple ticket purchase, you will select as many locations as the number of tickets purchased. When you are ready to purchase your ticket(s), follow the on-screen instructions to provide your contact details and then your credit card details. When your credit card payment is cleared we will then contact you by email to confirm your entry into the competition. Please note that when entering online you will not be deemed entered into the competition until we confirm your ticket details back to you by email.

4. The competition prize is a property located at 48 rue du Capitaine Roucher, 34130 Lansargues France. This property prize will be transferred by the Promoter to the winner of the competition free from all mortgages, charges and other encumbrances, at the Promoter’s expense and including all fees, charges and taxes.

5. When the maximum number of 20,000 entries or closing date of 31 December 2009 at 23.59pm GMT is reached, the competition will close. The centre of the ball position will be determined by an independent judge (a sporting expert appointed by the Promoter), using his football experience in the presence of a lawyer and a representative from the Promoter. The judge’s chosen position will then be computed against the database of coordinates to mathematically calculate which of the competitors is closest to the judge’s position, and therefore the winner of the prize. The winner will be the person who correctly identifies, or if no one is correct, who is closest to, the grid square within which the centre of the ball is judged to be located. In the event of a tie, the joint winners will be asked to take part in another “spot the ball” competition so that we can determine a single winner. The entry mechanism will be exactly the same as before but reserved to the joint winners, with a new football photograph and there will of course be no payment due. The competition will be judged in exactly the same way to determine the winner. In the very unlikely event there is another tie the process will be repeated until there is a single winner. The winner of the tie break will receive the competition prize. The other entrant(s) involved in the tie break won’t receive any form of compensation. All decisions of the judge will be final and binding on the competitors and no correspondence will be entered into. All competitors are automatically entered onto Win Property Online Limited’s database for the purpose of conveying information as to the status of this competition, as well as for any future promotions, competitions or deals offered by Win Property Online Limited.

6. The winner will be notified at the address or telephone number given in the contact details within 10 business days of the closing date of the competition. Any entrant may check the results of the competition which will be posted within 20 business days of the closing date of the competition on our website www.winpropertyinfrance.com.

7. The winner will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or they had authorisation to use it, before any prize will be paid or delivered. The winner will also be required to provide photographs for use in future marketing by the Promoter. Following receipt and verification of the details above by the Promoter, the winner will be contacted in order to make arrangements for delivery of the prize.

8. Acceptance of the prize by the winner gives the Promoter the right to use the prize-winner’s name, personal photograph and home country for promotional purposes, both immediately after their win and in the future, unless prohibited by law.

9. All entries to the competition are final and no refunds shall be made at any time or for any reason. Each competition entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this prize competition.

10. If the competition winner cannot be contacted by the Promoter within 30 days of being notified of their status as the winner by e-mail, telephone and mail to the contact details submitted in their entry, the Promoter shall be entitled to award the Prize to the competition entrant having provided the second closest coordinates to the competition judge’s position.

11. If the actual number of entries recorded is not equal to the maximum number of 20,000 entries at the closing date, the competition will close and the proceeds will be determined using the formula “number of tickets sold x ticket price”. In this case, the Promoter will be entitled to retain 14.9% of total proceeds corresponding to output VAT on ticket sales + £10,000 to cover technical, administration and marketing expenses incurred for the competition. The remaining cash balance will then be awarded to a winner selected through the same procedure as in the case of the maximum number of entries being reached.

12. The Promoter accepts no liability for errors or omissions contained within the prize details, description or specification or any other part of the Winpropertyinfrance.com website. It is the responsibility of each entrant (and in particular the winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.

13. An entry shall be declared void (without any refund being given) if the entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the website.

14. The Promoter makes no representation or warranty as to the valuation of the property prize, its structural or cosmetic condition or its ability to be sold. Entrants should make and rely on their own enquiries and legal advice about the prize before entering this competition.

15. The Promoter makes no representations or warranties as to the quality/suitability of the property offered as prize. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize-winner and, where applicable, to any family/persons accompanying the winner, or in connection with any of the competitions promoted by the Promoter.

16. No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.

17. Data Protection Notice: Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter (i) to administer the competition. In order to process, record and use your personal data the Promoter may disclose it to (i) comply with any legal or regulatory requirement of the Promoter in any country; and (ii) prevent, detect or prosecute fraud and other crime.
